en el Instituto de Formaci&oacute;n Docente y T&eacute;cnica N&ordm; 128, perteneciente a la Unidad Acad&eacute;mica Escuela Normal Superior en Lenguas Vivas &ldquo;Rafael Obligado&rdquo;, dependiente de la Direcci&oacute;n de Educaci&oacute;n Superior (de ahora en adelante &ldquo;DES&rdquo;) de la Provincia de Buenos Aires. Enmarcado en la Ley Provincial de Educaci&oacute;n N&ordf; 13688. <br \/><\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"text-decoration: underline;\"><span style=\"font-size: 12pt; font-family: Arial;\">ARTICULO 2 &ndash; OBJETO<\/span><\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">Este Acuerdo Institucional de Convivencia (de ahora en adelante &ldquo;AIC&rdquo;), est&aacute; conformado por el conjunto de principios, normas, organizaci&oacute;n y pr&aacute;cticas institucionales democr&aacute;ticas que regulan las acciones entre los miembros de la instituci&oacute;n y posibilita el cumplimiento de los fines educativos de la misma.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">El Consejo Acad&eacute;mico Institucional (de ahora en adelante &ldquo;CAI&rdquo;) establecer&aacute; <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>la forma de aplicaci&oacute;n del AIC a partir de la definici&oacute;n de acuerdos institucionales. Estos ser&aacute;n una v&iacute;a para que la convivencia diaria permita enlazar normas y objetivos institucionales que promuevan:<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt 36pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">Para la elaboraci&oacute;n de los acuerdos, el CAI contar&aacute; con la colaboraci&oacute;n de la DES a trav&eacute;s de documentos generados para tal efecto, tal como La Resoluci&oacute;n N&deg; 2383\/05, <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>el presente AIC deber&aacute; ser aprobado por la misma.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">El presente r&eacute;gimen es aplicable a todos los estudiantes del nivel terciario del Instituto, por los actos que realicen en el establecimiento o fuera de &eacute;l, en tanto afecten a la instituci&oacute;n, con motivo u ocasi&oacute;n del ejercicio de su calidad de estudiantes. El esp&iacute;ritu imperante en el tratamiento de las transgresiones ha de ser en pos de la reflexi&oacute;n hacia el cambio de actitudes teniendo en cuenta siempre el proceso de formaci&oacute;n integral y los principios establecidos en el art. 12 del presente acerca del tratamiento de los conflictos.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"text-decoration: underline;\"><span style=\"font-size: 12pt; font-family: Arial;\">ART&Iacute;CULO 18 &#8211;<span style=\"mso-spacerun: yes;\">&nbsp; font-family: Arial;\">: agresi&oacute;n verbal, o falta de respeto a las autoridades y\/o cualquiera de los miembros de la comunidad educativa, intento de obtener mejores resultados acad&eacute;micos utilizando el enga&ntilde;o, resistencia activa o pasiva al cumplimiento de lo indicado por el personal seg&uacute;n las pautas acordadas con el nivel institucional, todo comportamiento deliberado que se aparte de las pautas establecidas en el Cap&iacute;tulo III de este AIC.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt 18pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt 35.4pt; font-family: Arial;\">FALTAS GRAVES<\/span><\/em><\/strong><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">: agresi&oacute;n f&iacute;sica a cualquier miembro de la comunidad educativa o a un externo, dentro de la instituci&oacute;n o con motivo u ocasi&oacute;n del ejercicio de la calidad de estudiantes, participaci&oacute;n directa en des&oacute;rdenes que produzcan da&ntilde;os al prestigio y\/o bienes del establecimiento, la reincidencia en faltas leves.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt 35.4pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">De cometerse estas faltas, podr&aacute; suspenderse al alumno hasta por sesenta (60) d&iacute;as corridos, lo que traer&aacute; aparejado considerar como injustificadas las inasistencias.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt 36pt; text-indent: -18pt; text-align: justify; tab-stops: list 36.0pt; mso-list: l16 level1 lfo8;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">FALTAS GRAV&Iacute;SIMAS<\/span><\/em><\/strong><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">: adulterar y\/o falsificar actas de ex&aacute;menes u otros instrumentos que acrediten sus conocimientos, sustituir o ser sustituido en un examen, incurrir en conductas tipificadas en el C&oacute;digo Penal en perjuicio de la Instituci&oacute;n o de cualquiera de los miembros de la comunidad educativa.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt 35.4pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">De cometerse estas faltas podr&aacute;n aplicarse estas sanciones: suspensi&oacute;n de sesenta y un (61) d&iacute;as corridos a doce (doce) meses, lo que traer&aacute; aparejado considerar como injustificadas las inasistencias.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"text-decoration: underline;\"><span style=\"font-size: 12pt; font-family: Arial;\">ARTICULO 19 &ndash; DE LA APLICACI&Oacute;N<\/span><\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">Las sanciones por faltas leves y graves ser&aacute;n aplicadas por el rector conjuntamente con el CAI. Las grav&iacute;simas ser&aacute;n aplicadas por la DES.<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"text-decoration: underline;\"><span style=\"font-size: 12pt; font-family: Arial;\">ARTICULO 20 &ndash; DE LOS RECURSOS<\/span><\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">Los estudiantes a quienes se les impute la comisi&oacute;n de una falta tendr&aacute;n derecho a conocer previamente la intervenci&oacute;n del CAI y la imputaci&oacute;n que recaer&iacute;a sobre ellos, a explicar y dar a conocer las razones de sus actos, si as&iacute; lo desearan, asegurando al afectado \/ a el pleno derecho a la defensa. En el acta correspondiente se dejar&aacute; constancia del descargo o del no uso de dicho derecho. <\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">Cuando al estudiante se le impute la comisi&oacute;n de faltas graves, el CAI proceder&aacute; a efectuar una investigaci&oacute;n a fin de relevar informaci&oacute;n para la toma de la decisi&oacute;n correspondiente. Cuando la falta sea grav&iacute;sima, el CAI proceder&aacute; a efectuar una investigaci&oacute;n a los efectos de determinar lo ocurrido, elev&aacute;ndose todos los antecedentes, incluido el descargo, a la DES. <\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 12pt; font-family: Arial;\">&nbsp;<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;
